Kaider v. Hamos et al. – Stop Welfare to Illegal Immigrants
This case challenges the policy of the State of Illinois to allow unauthorized aliens (illegal immigrants) to obtain public benefits through the “All-Kids” and “Mom’s and Babies” programs. Our challenge to the state’s policy is made pursuant to the Illinois law permitting taxpayers to enjoin state officials from disbursing money illegally. Illinois’ decision to allow illegal immigrants to sign up for cash assistance through these two large entitlement programs directly contradicts a federal law which forbids state and local governments from providing any “public benefit” to most legal immigrants and all illegal immigrants. The Circuit Court of Cook County dismissed our suit.
On March 20, 2012, the Illinois Appellate Court (First District) held an extended oral argument of the case. The oral argument can be heard here: Kaider oral argument
