You are suing a bad guy or business who has harmed your client. Your lawsuit probably has counts for breach of contract, fraud and some type of business tort. You’ll claim actual and possibly punitive damages and perhaps attorney’s fees are permitted by contract, but otherwise they will not be available.
But bad actors don’t usually stop at a single victim. That’s where I come in. - Has the bad guy or business used the U.S. Mail or interstate wires (including email, text messaging and phone calls) to commit the bad acts?
- Has the bad guy operated through a business entity or if the defendant is a business, has it acted through a group of affiliated businesses or people?
