		<description>I am just a student but it seems to me that Elk was not born in the US but rather in an autonomous region and that it could even be argued that he was a member of a nation at war, which would discredit the relevance of this case in the discussion.  Otherwise this is a compelling situation but much like other 14th amendment issues is going to be interpreted in either a nativist or immigrant context depending on social influence on the court.</description>
